Our approach to FENE

As a FENE evaluator, Adam’s goal is to reach a signed agreement on all financial issues after a well-informed discussion on all marital and non-marital property, and if spousal maintenance is at issue, a discussion on the incomes, expenses and health of both spouses. For these well-informed discussions to be had, it is very important that both spouses exchange relevant financial documents prior to the FENE session, and at a minimum, at the session itself.

Providing Evaluative Feedback

As part of the FENE process, Adam will provide evaluative feedback to the spouses when agreements cannot be reached or when requested of him. Adam has worked within the area of family law for over twenty years, and has a wealth of experience in all financial issues that may arise as part of the divorce process. If a relatively small disagreement arises during the FENE process, Adam will provide his evaluative feedback right away to keep the process moving along. If the parties’ disagreement pertains to a significant issue, such as whether spousal maintenance should be ordered and if so, the amount and duration, Adam will provide his preliminary feedback to move the discussion along.

However, what if the parties want Adam to make a non-binding recommendation on the issue of spousal maintenance (whether it should be ordered, and if so, the amount and duration)? In such a case, Adam will normally request that both sides provide follow-up written submissions on the issue, and then Adam will issue a written non-binding decision on the issue.
